The process of approximation of national legislations with acquis of the EuropeanUnion (EU) is a challengein the framework of the integrating process for the countries that aspire to join EU. The approximation of national legislation with the acquis of the EU means that thecountry should be prepared to undertake a legal reform in order that the existing and the new laws should be in compliancewith the EU legislation.
The Stabilisation and Association Agreement signed between the European Union and its member states and the Republic of Albania on 12th of June 2006, obligates the Albanian state to approximate the domestic legislation with the acquis of the EU.
The article aims at describing the complexity of this process by considering it as a challenge for Albaniaand by focusing on the following directions:
- The legal reform and the approximation of the Albanian legislation with the acquis of the EU.
- The constitutional framework and the position of Stabilisation and Association Agreement.
- The drafting of the legal acts by basing on the approximation instruments.
This article will be based on description and also on analysis of the legal acts and different documents to give evidence that the legal reform and the law drafting process should fulfil the Europeanintegration needs.
