Abstract
This paper analysed the concept and theory of possession and ownership under the Common Law. The research was motivated by fact that the terms “Possession” and “Ownership” are always giving rise to trouble and surrounded with complexity as a result of numerous competing concepts or theories of possession and ownership with each theory seeking supremacy over another as a universally recognized definition of possession and ownership as has been urged that there is a unitary concept of possession and ownership. It is against this that the paper addressed the issue of the battle for supremacy among the different compelling concepts and theories of possession and ownership. In accomplishing this, a doctrinal method was adopted, having analysed the concept it was found that no single concept or theory of possession and ownership can be said to have laid down a universally encompassing and exhaustive or exclusive definition of possession and ownership and finally recommendation was given.
