The Electoral Act 2010 (as amended) is the basic legal framework regulating elections and electoral processes generally in Nigeria. This article examined radical innovations that the Act which has been used to conduct two General Elections in Nigeria so far, in 2011 and 2015, brought into the electoral process through its novel provisions. The article identified some of those innovations as including enhanced provision for substitution of candidates by political parties; equipping the Independent National Electoral Commission (INEC) with power of deregistration of political parties; placing limits on election expenses; abridgment of time for registration of voters, updating and revision of voters register; and vesting the courts with power of disqualification of candidates for submission of false information to INEC, among others. However, with the operation of the Act over the past seven years, there is urgent need for reform of the Act to fill the dangerous gaps existing in it, which include but not limited to issues of use of smart card reader and electronic voting, substitution of a candidate who dies after commencement of voting at an election but before declaration of results and return of a winner, tenure and qualification of Secretary to INEC, submission of list of candidates and their affidavits to INEC before elections, and burden of proof at election petitiontribunals. Making use of statutory and judicial authorities, as well as learned works in this area of law, this article recommended a comprehensive amendment of the Act to introduce significant reforms in the overall interest of the electoral process in Nigeria. It concluded that the challenges bedevilling elections and electoral process in Nigeria are legion, and are not restricted to lapses in the Electoral Act, 2010 but also extends to attitudinal challenges on the part of the electorates and the politicians. The paper finally called for reorientation and moral rearmament so as to take Nigerian democracy to an advanced level.
