The European Union Directive2008/101/EC extends the European EmissionTrading System to domestic and international civil aviation. This infuriated third countries due to its unilateral nature with extraterritorial effect. In 2013 the European Parliament and the Council passed a Decision No.377/2013/EU that demands the union to derogate temporarily from Directive 2003/87/EC.
Hence, this article inquire the legality of EU aviation directive 2008/101/EC and Decision No.377/2013/EU under the doctrine of sovereignty. Through analysis, the articlewill discuss: how the EU aviation directiveviolates the doctrineof sovereignty and whether the Decision can twine the previous directive in line with the principle of sovereignty. It concludes, the EU aviation directive violates the doctrine of sovereignty and the Decision fall short of mending what went wrong under the directive. Hence, the EU Parliament and Council must call for a reformon its aviation directives and decisions.
